STUDIOHUB TEXT MESSAGE TERMS AND CONDITIONS

4.1 Arbitration Agreement: You and StudioHub agree to resolve any disputes arising from these Terms through binding arbitration, except where prohibited by law. Arbitration replaces the right to go to court, except for limited circumstances listed below.

4.2 Exceptions: Either party may:

- Bring individual claims in small claims court.

- Seek injunctive relief for intellectual property claims.

- File a complaint with an applicable regulatory agency.

4.3 Class Action Waiver: You agree that disputes will be resolved only on an individual basis. You waive any right to participate in class, consolidated, or representative actions.

4.4 Arbitration Procedures: Arbitration will be conducted by a neutral arbitrator and administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You may initiate arbitration by submitting a Demand for Arbitration to StudioHub.

4.5 Opt-Out of Arbitration: You may opt out of this arbitration agreement by notifying StudioHub in writing within 30 days of opting in to receive text messages. Your notice must include your full name, phone number, and a statement that you opt out of arbitration.

4.6 Costs: If the arbitration filing fee exceeds $200, StudioHub will pay the excess amount unless the arbitrator determines your claims are frivolous.

4.7 Location: Arbitration hearings will take place in a mutually agreed-upon location or remotely, depending on the circumstances.

4.8 Enforceability: If this arbitration agreement is deemed unenforceable, disputes will be resolved exclusively in the state or federal courts of Pompano Beach, Florida.
